On the day of his trial last week, the Crown Prosecution Service (CPS) withdrew a charge against a Bath man accused of having a dog dangerously out of control which caused injury to a labrador.

At the hearing on Friday 7th November, the CPS also dropped another charge against Stuart Benham of using threatening, abusive or insulting words or behaviour with intent to cause fear of unlawful violence on the same date, 5th February 2025.
Mr Benham, 40, of Sheridan Road, had denied both offences when he appeared at Bath Magistrates’ Court in August.
It had been said that at Woodhouse Road in Bath his alapaha blue blood bulldog had bit a black labrador’s testicles so badly that the animal had to be castrated.
However, a legal element had been missed so the charge was withdrawn by the CPS.
The public order offence was also withdrawn after a witness failed to attend, so no evidence was offered to the court.
Mr Benham was due to be reunited with his dog, which has been held in a police compound for nine months.
“He’s a good boy,” Mr Benham told the court.
